5. Content Guidelines

You may submit content including profile information, photos, videos, and messages ("User Content"). You retain ownership of your User Content but grant us certain rights as described below.

5.2 Content License

By posting User Content, you grant PornHub a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, display, and perform your content for purposes of operating and promoting the Platform.

5.3 Content Restrictions

You may not post content that:

• Is sexually explicit, pornographic, or excessively violent
• Promotes illegal activities or hate speech
• Violates privacy rights or contains personal information of others
• Infringes copyright, trademark, or other intellectual property rights
• Contains misleading or deceptive information
• Promotes self-harm or violence

5.4 Content Moderation

We reserve the right to review, monitor, remove, or modify any User Content at our discretion, without notice, for any reason including violation of these Terms.

6. Verification and Safety

We offer optional identity verification services to enhance user safety. While we implement security measures and verification processes:

• We do not guarantee the identity or background of any user
• Verification does not constitute an endorsement
• You are responsible for your own safety when interacting with other users
• We recommend taking appropriate precautions when meeting someone in person

7. Premium Membership and Subscriptions

7.1 Subscription Plans

7.2 Billing and Payment

By purchasing a subscription:

7.3 Price Changes

7.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods except as required by law or outlined in our Refund Policy.

8. Intellectual Property Rights

The Platform, including all content, features, functionality, software, designs, graphics, logos, and trademarks, is owned by PornHub and protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the Platform
• Reverse engineer or decompile any software
• Remove proprietary notices or labels

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATING.COM SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, special, or punitive damages
• Lost profits, revenue, or data
• Service interruptions or errors
• User conduct or content
• Damages arising from relationships formed through the Platform
• Unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless PornHub, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your User Content
• Your violation of any rights of third parties
• Your violation of applicable laws

13. Termination

13.1 Termination by You

You may terminate your account at any time by accessing account settings and selecting the delete account option, or by contacting customer support.

13.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Platform, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Harmful conduct toward other users
• Non-payment of subscription fees
• Any reason at our sole discretion

13.3 Effect of Termination

Upon termination:

• Your right to access the Platform immediately ceases
• Your profile and User Content may be deleted
• You remain liable for any outstanding obligations
• Provisions that by their nature should survive termination will continue to apply

14. Dispute Resolution

14.1 Informal Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at [email protected]. We will work in good faith to resolve the matter within 30 days.

14.2 Arbitration Agreement

Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English, and the decision will be final and binding.

14.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis and waive any right to participate in class actions or class-wide arbitration.

14.4 Exceptions

Either party may seek equitable relief in court for intellectual property infringement or unauthorized access to the Platform.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Delaware.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on the Platform
• Updating the "Last Updated" date
• Sending email notification for significant changes

Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Platform.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it in the future.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PornHub regarding your use of the Platform and supersede all prior agreements and understandings.

20. Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.
